They must know the suit is without merit, but were likely counting on the fact that Atrios wouldn't want to have his identity revealed, which could happen even if the suit is frivolous.
I, too, was recently threatened with legal action by Luskin, for posting an excerpt from a rather absurd e-mail he sent me. But apparently I didn't rate a lawyer letter. [...] In any case, my reply to Luskin was, and I quote: "See you in court, asshole."

Your point about the fellow-travellers is the key, I think. I saw two posts in the Corner today knocking Luskin. I'm not sure he foresaw that.
