The fallacy is the assumption that lower level folks who are caught violating Title 18 aren't punished. But they are. And so should Rove be.

If you have information on prosecutions under the Espionage Act that 1) don't involve giving classified information to foreign governments and 2) seem reasonable to you, I would genuinely like to see it.

Uses of the Espionage Act that don't fit those criteria are disturbingly common.

Whoever leaked to Novak deserves punishment. But I don't like the idea that someone who propagates information already made public is also subject to prosecution. That's a law that should be taken off the books, not exploited. If liberals support it now, they won't have a leg to stand on when it's used against journalists and private citizens.
