We sort of skipped 3rd party beneficiaries in contracts, but it seems not impossible to me that members of the public could sue the paper for violating that clause. The problem would be the measure of damages, and with no expectation or reliance damages that I can think of, they'd have to settle for restitution. So maybe they can get their subscription fees back.
